Section A                        :                        Meaning of this agreement

i)   By agreeing to these terms and conditions, you are bound by the words and statements made here completely and shall abide by all rules and regulations of the company and the government of India.

ii)   Any changes made in this reference shall be made public by displaying on the frequently visited space on the website and it will be your responsibility to receive all necessary information and understand and abide by the changes. Your continued use of the website will be considered as your consent to the changes made in terms & conditions.

Definitions

Agreement refers to a document (physical or electronic ) containing a set of terms and conditions which must be agreed and followed by the both the parties in order to have trust and transparency in the actions of each other.

P2pfair refers to www.p2pfair.com, which is a registered domain name, and service is provided by yahoo.com. Www.p2pfair.com is also an independent proprietorship firm having it’s office at 45/A, veer savarkar block, shakarpur, delhi -92, India

Customer is a prospective member, who is not registered with p2pfair but visits all the public sections.

‘You is the term used for customers or members using services of p2pfair.com

Member a person whose details are registered with p2pfair and could visit all the sections of website public and private depending on the grade of membership.

Confirmed & Uncertain deal

Website refers to www.p2pfair.com as mentioned above.

Liability refers to the binding of the member to it’s statement/ listing/ information provided to p2pfair and hence a strong will to acquire/deliver the corresponding item mentioned for trade.

Security money refers to the amount which is deposited by the member with p2pfair in order to reconfirm the details provided are true and liable to deliver the same and if fails that amount is forfeited or lost by the member.

Transaction refers to the deal which occurs when the two consecutive parties agrees for a amount in order to exchange their needs/requirements.

Government of India refers to the legal system of India, which governs all the actions of the people trading in India, and prohibits various actions, which are against the society and the country.

You refers to any person who may be customer or member of p2pfair and accessing information and services of the website.

Section B :                        Agreement

Customer / member hereby state that

1)   you have completed the age of 18years and have good health of your mind and is legally responsible for all actions taken by you.

2)   You are eligible to make legal agreement with us and the details you have provided  are yours and you are not representing any body else and hence, you are fully responsible for any action taken from your account by you or by any  of  your representative accessing the website on your behalf and p2pfair will not be held responsible for any claims, losses or mishappening, if occurs in this concern due to any such action.

3)   You are the owner/ legal authorized representative to put the details of your requirement/listing and you are liable to acquire/deliver the corresponding product/service by paying/receiving the agreed money.

4)   You are not associated with any illegal malpractice and will not make use of p2pfair for displaying, obtaining, transmitting any illegal information to any destination.

5)   You have fully understood the procedures of operation, business, transaction on p2pfair and you will not held responsible for any unfavorable event, loss,  mishappening, if occurs on any account due to operation of p2pfair.

6)   You have never committed any bank fraud, default, bankruptcy, and criminal activity and have always maintained a peaceful relationship with your creditors.

7)   You will honor all cheques, payments made through third party on your behalf and will accordingly credit them as per your mutual agreements.

8)   You will not hack, manipulate, modify, alter, disable, reproduce, copy, transmit, distribute all or any part of the website in any manner, whether it affects our business operation or not, without our written permission.

9)   You will not make any objectionable, pornographic, obscene display of information in any part of the p2pfair.

10) You will abide by the rules of the government of India and will not do any action in any manner, which may be objectionable by the government.

11) You should able to access all the functions of the p2pfair only after fulfilling all the formalities/requirements of the website.

12) You should be able to visit all the public sections of the website but should not be able to take any action until you register yourself and login in the designated format.

13) You fully understand the word liability (means will have to pay/deliver if such action is taken) and will fulfill/deliver necessary credits to the p2pfair whenever demanded.

14) You fully understand the word security money (means money kept as deposit with company without interest and can be adjusted to fulfill any liability) and will credit the company account in order to receive credits necessary for taking action.

15) You fully authorize us for displaying/using all necessary information to enable transaction to take place and could verify all details provided by you.

16) You will keep all the secure information like passwords and other details safe with you and will not share with any known or unknown person, which may adversely affect the transactions from your account, and if done so you will be fully responsible for any such action and p2pfair will not be held responsible for any unfavorable action if takes place.

17) You will frequently visit the website and will inform if any error or mistake comes to your notice which adversely affects your account or public sections of the website.

P2PFAIR hereby state that

1)      It offers its services to customers by providing a platform where members can display their information and could perform subsequent actions.

2)      The prices displayed at our website are the bids or offers from the customers about their relevant property and we do not allot or allocate any prices to any property or area. The analyses are based on the prices & other data provided by the customers.

3)      It will not be responsible for any losses or damage caused due to any inconsistency in operation of website arising due to errors, faults, defects, transmission or failure of network due to any other reasons which exist temporarily or permanently and are beyond the manageable reach of p2pfair

4)      It is not responsible for any aftereffects, which may arise in the family due to ambiguous situations of decision-making about the sale or price of any property.

5)      It is not responsible for any losses/ adverse affects which may occur due to unavailability of the website due to any reasons like up gradation of website, technical faults, Link failure, web space unavailability, data jams, website hacking, power cuts, system/ machine failure, software failure, networking / communications failure, political instability, external interference, government policies, natural disaster etc. P2PFAIR reserves the right to suspend/cancel its any or all services without having any liability of losses/ damage whatsoever, during any unmanageable situations, if arises.

Government

We are hereby bound by the laws of government of India and in case of any dispute, court of Delhi or higher courts in Delhi will be considered as the supreme authority.
Government will honor all it’s rules & guidelines presently applicable and should there be any change in the policy affecting the business, should be informed publicly.
